Throughout these Terms and Conditions, “we”, “us” and “our” refer to Richard Darani. “You” and “your” refer to the person using this website or purchasing from us.

Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to sell our products. Your contract for any purchase is with Richard Darani, not Shopify.

SECTION 2 — THESE TERMS

These Terms and Conditions apply when you use our website or place an order through richarddarani.co.uk.

By placing an order, you confirm that you have read and accepted these Terms. Nothing in these Terms affects your statutory rights as a UK consumer.

You must be at least 18 years old, or have permission from a parent or guardian, to place an order.

These Terms primarily apply to purchases made for personal or household use. Separate terms may apply to wholesale or other business orders.

SECTION 3 — PRODUCTS

We make every reasonable effort to ensure that product descriptions, sizes, materials, prices and photographs are accurate.

Colours may appear slightly different depending on your screen settings, printing method and materials. Some handmade, printed or finished products may also have small natural variations. These variations do not affect your right to receive products that are of satisfactory quality, fit for purpose and as described.

Some products are made or dispatched by carefully selected print and fulfilment partners. Where relevant, this will be explained on the product page.

Product packaging may occasionally differ from photographs without affecting the product itself.

We may change or discontinue products before an order is accepted. Any changes made after an order has been accepted will not materially reduce the quality or description of the product you ordered.

SECTION 4 — ORDERS

When you place an order, you are offering to purchase the products in your basket.

After ordering, you will receive an email acknowledging your order. This acknowledgement does not necessarily mean that we have accepted it.

A contract is formed when we send confirmation that your order has been accepted or dispatched. For personalised products, the contract may be formed when we confirm that production has started.

We may be unable to accept an order if:

• a product is unavailable

• payment cannot be authorised

• the delivery address is outside the areas we serve

• we identify an obvious pricing or product-description error

• we reasonably suspect fraudulent or unlawful activity

If we cannot accept an order after payment has been taken, we will notify you and provide a full refund.

Please check your order carefully before submitting it. If you notice an error, contact richard@richarddarani.co.uk as soon as possible. We cannot guarantee that changes can be made after production or dispatch has started.

SECTION 5 — PERSONALISED PRODUCTS

You are responsible for checking that names, dates, wording, photographs and other information supplied for personalised products are correct.

We will produce personalised items using the information you provide. We are not responsible for errors contained in information supplied by you, but we remain responsible for any production errors made by us or our fulfilment partners.

Once production begins, it may not be possible to change or cancel a personalised order.

The statutory change-of-mind cancellation right may not apply to products made to your specifications or clearly personalised. This exception does not affect your rights if the product is faulty, damaged, misdescribed or produced incorrectly.

SECTION 6 — PRICES AND PAYMENT

All prices are displayed in pounds sterling.

Prices include any applicable taxes. Delivery charges are calculated separately and shown during checkout before you place your order.

We may change prices at any time, but this will not affect an order that has already been accepted.

If a product has been listed at an obviously incorrect price, we may contact you before accepting the order and give you the choice of proceeding at the correct price or cancelling it.

Payment must be authorised before an order can be processed. Payments are handled securely by Shopify and the payment providers displayed during checkout.

Promotional codes and discounts may have their own conditions, including expiry dates, minimum spends or product exclusions. Unless stated otherwise, promotional offers cannot be combined.

SECTION 7 — DELIVERY

We currently deliver to United Kingdom addresses only.

Delivery dates are estimates unless we have expressly agreed a guaranteed date. We will deliver within the agreed timeframe or, where no separate timeframe has been agreed, within 30 days of accepting your order.

We are responsible for the goods until they are delivered into your physical possession or the possession of someone you have identified to receive them.

If delivery is delayed by circumstances outside our reasonable control, we will contact you where possible and take reasonable steps to minimise the delay. Your legal rights concerning seriously delayed or undelivered goods remain unaffected.

You are responsible for providing a complete and accurate delivery address. Please contact us immediately if you notice an error. Address changes may not be possible after dispatch.

SECTION 8 — CANCELLATIONS, RETURNS AND REFUNDS

Our voluntary 30-day return policy and instructions for requesting a return are set out in our Refund Policy:

For most products purchased online, UK consumers have a legal right to cancel without giving a reason within 14 days after receiving the goods. After notifying us, the customer normally has a further 14 days to return them.

Legal exceptions include products made to the customer’s specifications or clearly personalised, and certain sealed hygiene products once opened.

These exceptions only apply to change-of-mind returns. They do not affect your rights where a product is faulty, damaged, unsafe, misdescribed or not fit for purpose.

Products purchased in a sale have the same statutory rights as full-price products.

Where a legal cancellation right applies, refunds will include the cost of our least expensive standard delivery service. Additional amounts paid for premium or express delivery are not normally refundable.

SECTION 9 — FAULTY, DAMAGED OR INCORRECT PRODUCTS

Under the Consumer Rights Act 2015, products must be of satisfactory quality, fit for their intended purpose and match their description.

If your order arrives faulty, damaged or incorrect, contact richard@richarddarani.co.uk with your order number and, where possible, photographs showing the problem.

Depending on the circumstances and your legal rights, we may offer a refund, repair or replacement. We will cover reasonable return costs where the product is faulty, damaged, misdescribed or incorrect.

Nothing in these Terms limits your statutory rights.

SECTION 10 — ACCOUNTS

If you create an account, you are responsible for keeping your login information confidential and for notifying us if you believe your account has been accessed without permission.

You must provide accurate and current information when creating an account or placing an order.

We may suspend an account where we reasonably believe it is being used fraudulently, unlawfully or in a way that threatens the security of the website or other customers.

SECTION 11 — INTELLECTUAL PROPERTY

Unless otherwise stated, all illustrations, characters, designs, photographs, product names, written content, logos, graphics and other original material on this website belong to Richard Darani or are used with permission.

You may browse the website and print or save information relating to your own orders for personal use.

You must not copy, reproduce, modify, distribute, sell, license or commercially use our artwork, designs, photographs or website content without prior written permission.

Purchasing a physical product does not transfer the copyright or other intellectual property rights in the design to you.

Shopify and other third-party names and logos belong to their respective owners.

SECTION 12 — REVIEWS AND CUSTOMER CONTENT

If you submit a review, photograph or other content to us, you confirm that:

• the content is your own or you have permission to submit it

• it is accurate and not misleading

• it does not infringe another person’s rights

• it is not unlawful, abusive, discriminatory or obscene

You give us a non-exclusive, worldwide and royalty-free permission to display, reproduce and share that content in connection with our website, products and marketing.

We may remove content that breaches these Terms or applicable law.

SECTION 13 — ACCEPTABLE USE

You must not misuse this website, attempt to gain unauthorised access, introduce viruses or other malicious code, interfere with its operation or use it for unlawful purposes.

You must not copy or commercially extract substantial parts of the website or product catalogue without permission.

We may restrict access where reasonably necessary to protect the website, our customers or our legal rights.

SECTION 14 — THIRD-PARTY SERVICES AND LINKS

Our website may use services supplied by Shopify, payment providers, delivery companies, review platforms and other third parties.

Third-party websites and services have their own terms and privacy policies. We are not responsible for their independent content or practices, although we remain responsible for performing our obligations under your order.

Shopify provides the platform used to operate our store but is not the seller of the products. Purchases made through this website are made directly from Richard Darani.

SECTION 15 — OUR RESPONSIBILITY TO YOU

We are responsible for losses you suffer that are a foreseeable result of our breaching these Terms or failing to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed or for losses caused solely by circumstances outside our reasonable control. This does not remove any rights you may have concerning delayed or undelivered products.

We supply consumer products for private and domestic use. We are not responsible under these consumer Terms for business losses such as loss of profit, revenue or commercial opportunity. Separate terms may apply to wholesale orders.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:

• death or personal injury caused by negligence

• fraud or fraudulent misrepresentation

• defective products where liability cannot legally be excluded

• breach of your statutory consumer rights

Shopify and other service providers may process information needed to operate the store, process payments, prevent fraud and fulfil orders. Further information is provided in our Privacy Policy.

SECTION 17 — CHANGES TO THESE TERMS

We may update these Terms to reflect changes to our business, website or legal obligations.

The Terms applying to an order will normally be those published when the order was placed. Changes will not retrospectively remove rights relating to an existing order.

The latest version will always be available on this page.

SECTION 18 — GOVERNING LAW

These Terms are governed by the laws of England and Wales.

If you are a consumer living in Scotland or Northern Ireland, you retain the protection of any mandatory laws applying where you live and may bring proceedings in the courts of that part of the United Kingdom.

SECTION 19 — GENERAL

If any part of these Terms is found to be unlawful or unenforceable, the remaining sections will continue to apply.

If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.

Nothing in these Terms is intended to give rights to anyone other than you and us, except where the law provides otherwise.
